Terms of Service

Effective date: 1 August 2026

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to betterthanreality.com and cloakanddaggerweekend.com (each, the “Site”) and your participation in experiences offered by BTR Media LLC (“BTR,” “we,” “us,” or “our”). By submitting an inquiry, booking, or participating in an experience, you agree to these Terms. If you do not agree, do not use the Site or participate.

2. Who We Are; Scope

BTR Media LLC is a Delaware limited liability company that designs and delivers bespoke, immersive intelligence- and tradecraft-based training and experiences. These Terms apply to all visitors, clients, and participants. Additional written agreements — including a separate assumption-of-risk and liability waiver, and, for Operation Suivi, gaming and KYC/AML terms — may apply and, where they conflict with these Terms, control as specified in those agreements.

3. Eligibility

Participants must be at least 18 years old (or the age of majority in their jurisdiction, if higher) and have full legal capacity to enter into a contract. Participation is by application and subject to BTR’s vetting and acceptance. BTR may decline or terminate participation at its sole discretion, including for safety, legal, regulatory, or conduct reasons.

4. Nature of the Experiences

The experiences are realistic, simulated scenarios provided for training and entertainment. BTR and its personnel do not act on behalf of, and BTR is not affiliated with or endorsed by, any government, intelligence, or law-enforcement agency. References to personnel backgrounds describe prior professional experience only. Outcomes are not guaranteed; scenarios are deliberately designed so that participants may not succeed.

5. Assumption of Risk and Acknowledgment

You acknowledge that the experiences may involve inherently dangerous activities, which may include firearms handling, breaching and forced-entry techniques, physical exertion, defensive tactics, travel, and real-money gaming. These activities carry risk of serious injury, death, property damage, and financial loss. You voluntarily and knowingly assume all such risks, whether known or unknown. Certain activities require you to execute a separate written assumption-of-risk and liability waiver before participating.

6. Waiver and Release of Liability

To the fullest extent permitted by applicable law, you release and hold harmless BTR, its members, personnel, instructors, contractors, and partners from claims arising out of your participation, except to the extent caused by BTR’s gross negligence or willful misconduct. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.

7. Health, Safety, and Conduct

You represent that you are physically and mentally fit to participate and will disclose any condition affecting your safe participation. You will follow all safety instructions and the directions of BTR personnel at all times, and you will not participate under the influence of alcohol or drugs. BTR enforces strict firearms-safety and activity-safety protocols and may remove any participant who violates safety rules or endangers others, without refund. Events that involve firearms, breaching, or other controlled activities will have a medical team and medical transport stationed on-site.

8. Firearms, Breaching, and Controlled Activities

Where an experience includes firearms, breaching, or other controlled activities, these are conducted under qualified, licensed supervision and in compliance with applicable law. Participants do not acquire, own, transfer, or transport any firearm, weapon, or controlled item. The legality of specific activities varies by jurisdiction, and BTR conducts each activity only where it is lawful to do so.

9. Operation Suivi and Real-Money Gaming

Operation Suivi includes a licensed, real-money private-gaming environment operated by our partner, Maximum Game, which is the licensed gaming operator. BTR is not a gambling operator. Participation requires identity verification and anti-money-laundering (KYC/AML) checks and is subject to the legal gaming age and gaming regulations of the applicable jurisdiction. You play with your own funds and are solely responsible for your gaming losses.

10. Booking, Payment, Deposits, and Cancellation

The specifics of booking an event, deposit amount, payment schedule, accepted methods, cancellation and refund policy, rescheduling, and no-show terms will be discussed with prospective clients during the initial meeting(s) and a copy of the terms will be agreed to and signed, in writing, by the prospective client before BTR begins working on the event.

11. Confidentiality

BTR maintains strict confidentiality regarding client identity and participation, consistent with its published privacy commitments. In turn, you agree to keep confidential BTR’s methods, scenarios, personnel identities, and venues, and the identity and participation of other clients, and not to record — by audio, photograph, or video — any part of an experience without BTR’s prior written consent.

12. Intellectual Property

All content on the Site, and all materials, scenarios, and methods used in the experiences, are the property of BTR or its licensors and may not be copied, reproduced, or reused without BTR’s prior written permission.

13. Media and Publicity

Consistent with BTR’s confidentiality model, BTR does not publish client names, testimonials, or photographs. Nothing in these Terms grants BTR a right to use your name or likeness, and nothing grants you a right to publicize your participation.

14. Third-Party Providers

Experiences may involve third-party venues, instructors, and partners, including Maximum Game. BTR is not responsible for the independent acts or omissions of third parties, and additional third-party terms may apply to your participation.

15. Indemnification

You agree to indemnify and hold BTR harmless against claims, losses, and expenses arising from your breach of these Terms, your violation of applicable law, or your negligent or wrongful conduct during an experience.

16. Disclaimers and Limitation of Liability

The Site and the experiences are provided “as is.” To the fullest extent permitted by law, BTR disclaims implied warranties and limits its aggregate liability to the amount you paid for the applicable experience. Nothing in these Terms limits any liability that cannot be limited under applicable law.

17. Force Majeure

BTR is not liable for any failure or delay in performance caused by events beyond its reasonable control.

18. Compliance, Export Controls, and Sanctions

You are solely responsible for ensuring that your participation complies with all applicable export-control and economic-sanctions laws. You represent and warrant that you are not a restricted, denied, or sanctioned party, and that you have fully and accurately disclosed any fact bearing on that status. BTR may, but is not obligated to, screen participants; any screening BTR performs is for its own compliance purposes only, is not a warranty, and creates no reliance by you. BTR’s failure to identify your restricted or sanctioned status — whether resulting from your non-disclosure, misrepresentation, or otherwise — does not relieve you of liability, transfer any liability to BTR, or create any defense for you against any claim, fine, penalty, sanction, or legal or regulatory action. You agree to indemnify BTR for any loss arising from a breach of this Section. Nothing BTR provides constitutes protection or immunity from any lawful legal or regulatory action taken against you.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The parties will first attempt, in good faith, to resolve any dispute through negotiation.

If a dispute is not resolved through negotiation, it shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware; provided that any dispute involving a party domiciled outside the United States, or which the parties otherwise agree to submit to arbitration, shall be finally resolved by arbitration under the Rules of the London Court of International Arbitration (LCIA) by one or more arbitrators appointed in accordance with those Rules. The Delaware courts shall retain jurisdiction for interim and injunctive relief and for enforcement of any arbitral award.

20. Changes to These Terms

BTR may update these Terms from time to time. The current version is posted on the Site with its effective date. Continued use of the Site or participation in an experience after an update constitutes acceptance of the revised Terms.

21. Severability; Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with any separate signed waiver, booking, gaming, and privacy documents, constitute the entire agreement between you and BTR regarding their subject matter.
